Now is the time to begin considering if you , a prospective employer, are interested in hiring a foreign national as an H-1B professional. The lottery season is gearing up on April 1 for starting dates of Oct.  1, 2015 .. There are only  65,000 cap subject visas available each fiscal year, with an additional 20,000 for those who have obtained a master’s degree in the USA from a qualifying public or not-for-profit US institution. It is important for employers to file by the first week of April 2015 so the petition will be entered in the lottery. Last year, for these few slots, 172,000 petitions were filed during the first week of April 2014. Note that certain institutions are exempt from the quota like universities and their affiliates, as well as non- profit research organizations. Also, if an individual has previously been counted against the quota, he/she will not be counted again if that person was already counted in the last  6 years..
