I-140/ I-485 Concurrent Adjudication

In addition, the DHS has also implemented an I-140 portability rule or 180-day rule, which states that I-140 petitions remain valid for a worker with respect to a new job whose I-485 adjustment application has remained unadjudicated by the DHS for more than 180 days. The rule applies if the worker has moved to a job that is the same or similar in nature to the one described in the I-140.
